A judge has ruled that three state agencies violated the Public Records Act in a case involving disputed tax credits for a planned film studio project in Baton Rouge.
State District Judge Janice Clark’s ruling came late Monday night after an attorney for the Baton Rouge developer embroiled in the tax dispute accused the state agencies of intentionally withholding public documents from the developer’s defense team.
At issue is whether 40 percent tax credits apply to what developer Robert Day builds by the end of this year or whether his status as a pre-certified film infrastructure project makes him eligible for credits on an ongoing basis after Jan. 1, 2010.
An attorney for the Division of Administration said the state 1st Circuit Court of Appeal will be asked to review Clark’s ruling.
